Family Awarded $800k in Chicken McNugget Burn Case

A civil lawsuit against McDonald’s and one of its franchisees has resulted in a Florida family being awarded $800,000 by a Broward County jury.

The lawsuit was originally filed in 2019 and alleged that “unreasonably and dangerously” hot chicken nuggets were provided in a Happy Meal and caused damage to the skin of then-4-year-old Olivia Caraballo, USA Today reported.

Olivia’s parents, Philana Holmes and Humberto Caraballo Estevez, claimed Olivia sustained second degree burns after a Chicken McNugget fell on her leg while she was sitting in the backseat of a car. Her mother claimed she received no warning from the restaurant that the food might be abnormally hot.

This week, the jury awarded the family a total of $800,000 for “pain and suffering, disfigurement, mental anguish, inconvenience, and loss of capacity for enjoyment of life. That includes $400,000 for injuries sustained in the past and $400,000 for damages the jury determined will be sustained in the future,” according to CNN.

McDonald’s has reportedly not commented on the situation.
